User Service Agreement and Conditions
www.europaforwards.com or www.europaforwards.de is operated by EUROPAFORWARDS SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (we, us and our). We are registered in Poland under company id KRS. 0001029610. NIP. 8581882708. REGON. 524962271. Our registered office is at 9, Rurka, 74-500 Chojna, Poland. Our POLAND VAT number is PL8581882708.
Kindly review these Terms of Trade thoroughly prior to becoming a Registered Member. By registering and utilizing the Services, you acknowledge and accept the binding nature of these Terms of Trade. This constitutes a legally binding agreement between you and us, which can only be modified with our written consent.
These Terms & Conditions (“Terms”) govern the contractual relationship between Europaforwards sp. z.o.o. (“Europaforwards”) and its customers who utilize the services provided by Europaforwards, including package forwarding, document handling, and related services. By using Europaforwards’ services, you agree to be bound by these Terms. Please read them carefully.
Definitions
“Europaforwards” refers to the company Europaforwards sp. z.o.o., offering package forwarding and document handling services.
“Customer” refers to any individual or entity utilizing Europaforwards’ services.
“Services” refer to the package forwarding, document handling, and related services provided by Europaforwards.
“Third Party” refers to any entity or individual other than Europaforwards or the Customer.
Account Registration
2.1. In order to use Europaforwards’ services, the Customer must create an account by providing accurate and complete information.
2.2. The Customer is responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.
2.3. Europaforwards reserves the right to terminate or suspend a Customer’s account at its sole discretion, without prior notice, if any fraudulent or unauthorized activity is suspected.
2.4 All Europaforwards Addresses shall be addresses at premises operated by us or on our behalf to provide our Services. We shall be entitled to alter your Europaforwards Address upon notice to you.
Package Forwarding and Document Handling
3.1. Europaforwards will receive, store, and forward packages on behalf of the Customer, as well as handle documents, subject to the terms and conditions outlined herein.
3.2. The Customer acknowledges that Europaforwards may inspect and open packages to ensure compliance with applicable laws, regulations, and restrictions.
3.3. Europaforwards will provide a warehouse in Poland for storing packages and documents before forwarding them shipment from Poland warehouse to the Customer.
3.4.1 The Customer is responsible for providing in writing or print format communication accurate product description and value of the goods with all the necessary valid invoices or any kind of purchased clear readable documents, scan copy/s.
3.4.2 The Customer is responsible for providing accurate and complete information for package delivery, including the correct shipping address and any necessary customs documentation.
3.5. A fee will be applied for utilizing the Forwarding Service (referred as to the Forwarding Fee). which is separate from the Personal Shopper Service Fee or the Distribution Service Fee (if applicable) when the Goods are received at your EuropaForwards Address via the Personal Shopper Service or the Distribution Service. If the Goods have been delivered to your Europaforwards Address through the Personal Shopper Service or the Distribution Service, the Forwarding Fee must be paid in addition to the corresponding Personal Shopper Service Fee or Distribution Service Fee (as applicable). The exact amount of the Forwarding Fee will be mutually agreed upon prior to arranging the forwarding of your Goods to the designated Delivery Address. Once we have received full payment of the entire Fee, we will promptly dispatch the Goods to your Delivery Address.
3.6. Europaforwards shall not be liable for any damages, losses, or delays arising from incorrect or incomplete delivery information provided by the Customer.
3.7. It is the Customer’s responsibility to initiate a shipping request for their packages or request document handling services.
3.8. If the Customer fails to place a shipping request or does not pay for document service charges within a reasonable timeframe, Europaforwards reserves the right to dispose of the packages or documents at its discretion.
3.9. Europaforwards shall not be liable for any damages, losses, or claims arising from the Customer’s failure to initiate shipping or unable to pay for document services.
Shipping and Customs
4.1. Europaforwards will ship packages from Poland to the Customer’s designated address using the shipping methods selected by the Customer.
4.2. The Customer acknowledges that shipments may be subject to import duties, taxes, and customs fees imposed by the destination country. Such fees are the sole responsibility of the Customer.
4.3. Europaforwards shall not be liable for any delays, damages, or losses caused by customs inspections, import duties, or any other actions or requirements of customs authorities. Kindly note it is the final customer who have to pay all the duties or any additional service charges to receive the shipment.
4.4. Europaforwards will use commercially reasonable efforts to ship packages to the Customer in a timely manner, but it does not guarantee delivery times.
Fees and Payments
5.1. The Customer shall pay the fees associated with the use of Europaforwards’ services, including package forwarding, document handling, storage, and additional requested services.
5.2. All fees and charges are exclusive of any applicable taxes, which shall be the sole responsibility of the Customer.
5.3. Europaforwards reserves the right to modify the fees and charges at its discretion, with reasonable notice provided to the Customer.
5.4. Payments shall be made by the Customer in the currency specified by Europaforwards, using the approved payment methods provided.
Limitation of Liability
6.1. Europaforwards shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use of its services, regardless of the cause of action.
6.2. Europaforwards’ liability, if any, shall be limited to the amount paid by the Customer for the specific service giving rise to the claim.
Termination
7.1. Either party may terminate the contractual relationship at any time by providing written notice to the other party.
7.2. Europaforwards reserves the right to terminate or suspend a Customer’s account without prior notice in the event of a breach of these Terms.
Website
8.1. Content, Intellectual Property, and Terms of agreement
Our website and the information presented therein are provided to visitors on a non-binding basis. While we strive to maintain accuracy, occasional minor inaccuracies or typographical errors may be present. However, we regularly conduct thorough checks and updates on both the website and user accounts. As a result, we reserve the right to make changes and amendments to the website content at our discretion. If such changes or amendments affect our general terms and conditions or services, we will promptly inform you. Please note that EUROPAFORWARDS assumes no liability for the content or accuracy of any websites linked to ours. We highly value the intellectual property rights of third parties and take great care to respect all copyrighted or trademarked materials. If you suspect any violation of intellectual rights, please contact us without hesitation. All trademarks and brands mentioned on our website belong to their respective owners. Any use beyond what is expressly permitted requires our explicit permission. In the event that we have reasonable grounds to suspect such activities, we reserve the right to block or delete customer accounts or refuse the agreed-upon services. Moreover, we retain the right to disclose customer data to relevant authorities or organizations in cases of misconduct.
Governing Law and Jurisdiction
9.1. These Terms shall be governed by and construed in accordance with the laws of Poland.
9.2. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Poland.
Entire Agreement
10.1. These Terms constitute the entire agreement between Europaforwards and the Customer, superseding any prior agreements or understandings, whether written or oral.
11.1.Liability for Content:
We have taken great care in compiling the contents of our website. However, we cannot guarantee the correctness, completeness, and timeliness of the provided information. As a service provider, we are responsible for our own content on these pages in accordance with § 7 Abs.1 TMG (German Telemedia Act) and general laws. According to §§ 8 to 10 TMG, we are not obligated to monitor transmitted or stored external information or to investigate circumstances that indicate illegal activity. Obligations to remove or block the use of information under general law remain unaffected. Liability in this regard is only possible from the moment we become aware of a specific infringement. - Complying with Legal and Safety Restrictions Guidelines on Export and Import Laws and Prohibited Goods
EuropaForwards strictly adheres to regulations and will neither accept nor ship goods that are prohibited or require special handling as mandated by the exporting or importing country, as well as transport regulations. Additionally, items restricted by licensing rights will not be shipped by EuropaForwards. Should any prohibited items be discovered during parcel inspection, we will promptly notify you and discuss the appropriate course of action. Unless alternative arrangements are made, the cost of returning the prohibited items to the original vendor will be borne by you, along with an additional processing fee for this service.
By using EuropaForwards, you acknowledge and agree to comply with all applicable provisions of the country of origin and the country of destination for the goods. Furthermore, you agree not to utilize EuropaForwards for the shipment of illegal goods. The determination of what constitutes illegal or prohibited goods is based on the specifications of the importing or exporting country, as outlined by the German Customs regulations, and in accordance with the guidelines provided by our shipping service providers, including DHL (Country-specific / General), FedEx, DPD, GLS, and UPS.
13. Please note that we operate a zero tolerance policy towards abusive or threatening behaviours directed towards our employees, associates, or customers. In cases where such behavior occurs, we reserve the right to terminate the membership and cease communication with any Registered Member engaging in such conduct. Furthermore, in such circumstances, we retain the right to dispose of any goods we currently hold or subsequently receive, using any appropriate means at our discretion.
14. Terms and Conditions – EuropaForwards Sp. z.o.o Extended Agreement
This agreement (“Agreement”) is entered into between you, the consumer, and EuropaForwards Sp. z.o.o (“EuropaForwards”). By utilizing the services provided by EuropaForwards, you acknowledge and agree to be bound by the terms and conditions set forth herein, as well as the terms and conditions of our global partner courier, collectively referred to as the “Courier Terms and Conditions.” It is imperative that you carefully read and understand the Courier Terms and Conditions before proceeding.
Acceptance of Terms: By using EuropaForwards’ services, you expressly acknowledge and agree that you are bound by both the terms and conditions outlined in this Agreement and the Courier Terms and Conditions. If you do not agree with any provision of these terms, please refrain from using our services.
Courier Terms and Conditions: As a consumer availing EuropaForwards’ services, you are required to adhere to and accept the terms and conditions established by our global partner courier. These terms cover various aspects of the shipping process, including but not limited to shipping rates, delivery times, liability for loss or damage, and other relevant policies. The Courier Terms and Conditions can be accessed on the official website of the respective courier.
Responsibility: EuropaForwards acts as an intermediary between you and our global partner courier. While we strive to ensure a smooth and reliable shipping experience, we shall not be held liable for any issues arising from the courier’s services, including but not limited to delays, damages, or loss of items. You agree that any claims or disputes related to the courier services will be resolved in accordance with the Courier Terms and Conditions.
Indemnification: You agree to indemnify and hold EuropaForwards harmless from any claims, losses, liabilities, or expenses arising from your use of our services or any violation of the terms outlined in this Agreement or the Courier Terms and Conditions.
Modification of Terms: EuropaForwards reserves the right to modify the terms and conditions of this Agreement at any time. Any such modifications will be effective immediately upon posting on our website. It is your responsibility to review the terms periodically, and continued use of our services after modifications constitutes acceptance of the revised terms.
Governing Law: This Agreement and any disputes arising out of or in connection with it shall be governed by and construed in accordance with the laws of Poland.
15. Confidentiality of Login and Password Information
By registering with EuropaForwards, you acknowledge and agree to the following terms and conditions regarding the confidentiality of your login and password information:
Confidentiality Obligation: You, as the registered user, agree not to share or misuse your login and password details with any third party. Your login credentials are for your personal use only, and you are responsible for maintaining the confidentiality of this information.
Automated Registration Termination: In the event that Europaforwards becomes aware of any unauthorized sharing or misuse of login and password details, your registration will be automatically terminated without prior notice. This termination may result in the loss of access to the platform and its associated services.
User Responsibility: You are solely responsible for any activity that occurs under your account, including but not limited to actions taken by individuals to whom you have shared your login and password details. EuropaForwards disclaims any liability for losses or damages incurred due to unauthorized access resulting from the sharing or misuse of login credentials.
Secure Handling of Credentials: It is your responsibility to ensure the secure handling of your login and password details. EuropaForwards will never ask you to provide your password via email or any other communication method. If you receive such requests, please report them immediately to our support team.
Notification of Unauthorized Access: If you become aware of any unauthorized use of your account or suspect that your login credentials have been compromised, you must notify EuropaForwards immediately. Prompt reporting allows us to take appropriate measures to secure your account.
Changes to Password: For security purposes, EuropaForwards recommends regular password updates. Users are encouraged to change their passwords periodically to enhance the security of their accounts.
Compliance with Laws: Users must comply with all applicable laws and regulations related to the use and security of login and password information.
